XTIAN (PTY) Ltd ("GreenLine", "we", "us", or "our") operates the GreenLine DNS filtering and internet safety service. These Terms of Service ("Terms") govern your use of our services.

By accessing or using GreenLine services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Service Description

GreenLine provides DNS-based content filtering services to help protect families and organizations from harmful online content. Our services include:

• DNS query filtering and blocking
• Malware and phishing protection
• Safe search enforcement
• Content category blocking
• Family management and device control
• VPN connection for DNS filtering on mobile devices
• Enterprise-managed firewall devices (select plans)

2. Service Limitations and Disclaimers

2.1 No Guarantee of Complete Protection

You acknowledge and agree that:

• No DNS filtering system is foolproof or 100% effective
• New threats, websites, and bypass methods emerge constantly
• Harmful content may occasionally slip through our filters
• Legitimate websites may sometimes be incorrectly blocked
• Our service is a tool to assist with online safety, not a complete solution
• Parental supervision and education remain essential for child safety online

2.2 Best Efforts Commitment

We commit to:

• Maintaining and updating our filter databases regularly
• Responding to user reports of missed threats or incorrect blocks
• Employing industry-standard security practices
• Continuously improving our filtering technology
• Providing transparent communication about service capabilities and limitations

3. User Responsibilities

As a user of GreenLine services, you agree to:

• Provide accurate registration and billing information
• Maintain the confidentiality of your account credentials
• Use the service in compliance with South African law
• Not attempt to circumvent, disable, or interfere with our filtering
• Not use our service for illegal purposes
• Supervise minors' internet use and not rely solely on our filtering
• Report false positives or missed threats to help improve the service

4. Liability Limitation and Indemnification

4.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW:

• GreenLine and XTIAN (PTY) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, goodwill, data, or other intangible losses
• We are not liable for harm resulting from exposure to harmful content that bypasses our filters
• We are not liable for legitimate content incorrectly blocked by our service
• Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim

4.2 Indemnification

You agree to indemnify, defend, and hold harmless XTIAN (PTY) Ltd, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the GreenLine service
• Your violation of these Terms
• Your violation of any South African laws or regulations
• Content accessed despite our filtering efforts
• Any failure to properly supervise internet use by minors under your responsibility
• Third-party claims related to your use of our service

5. Subscription and Billing

5.1 Payment Terms

• Subscriptions are billed in advance on a monthly, six-monthly, or annual basis
• All prices are in South African Rand (ZAR)
• Payment processing is handled by Paystack, our secure payment partner
• Subscriptions automatically renew unless cancelled

5.2 Refunds and Cancellation

• You may cancel your subscription at any time
• No refunds are provided for partial billing periods
• Cancelled subscriptions remain active until the end of the paid period
• Firewall hardware purchases are non-refundable

5.3 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Existing subscribers will be notified by email.

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for service interruptions due to:

• Scheduled maintenance
• Internet service provider issues
• Force majeure events
• Third-party service failures
• Circumstances beyond our reasonable control

7. Data Protection and Privacy

Your use of GreenLine is subject to our Privacy Policy, which complies with South Africa's Protection of Personal Information Act (POPIA). Please review our Privacy Policy for details on how we collect, use, and protect your information.

8. Intellectual Property

All content, trademarks, and intellectual property related to GreenLine services remain the property of XTIAN (PTY) Ltd. You may not:

• Copy, modify, or distribute our software or services
• Reverse engineer our filtering technology
• Use our trademarks without written permission

9. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Use the service for illegal purposes
• Fail to pay subscription fees
• Attempt to abuse or exploit our services

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the Republic of South Africa.

10.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

10.3 Dispute Resolution

Before pursuing legal action, parties agree to attempt resolution through:

1. Direct negotiation with our support team
2. Mediation if negotiation fails
3. Arbitration as a final alternative to litigation

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via:

• Email to the address on file
• Prominent notice on our website
• In-app notifications

Continued use of the service after changes constitutes acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
